During your initial interview, which may be either over-the-phone or in-person, depending upon the circumstances, we will want to hear about what happened to you. The length of the interview can vary, depending upon the extent of your injuries. As you tell us about your accident, we will ask questions and collect a variety of information from you such as:

  • Basic information such as your legal name, address, contact phone numbers, date of birth, and social security number.
  • The date and time of the accident and details about what happened.
  • Insurance coverage information. If this was an auto, tractor trailer, or motorcycle accident, your insurance information and the at-fault driver’s insurance information. Also, whether you have health insurance.
  • Whether you have talked to any insurance adjustors, and if so, what you said. Did you provide a recorded or written statement about the accident? Have you spoken to or been interviewed by anyone else about the accident or your injuries?
  • Whether police arrived at the scene of the accident, and if so, whether any citations were issued and whether a police/accident report was written.
  • Whether medic arrived at the scene of the accident. If so, were you transported to an emergency room?
  • Medical treatment you received for your injuries, such as names of providers and facilities, treatments you received such as x-rays or CT scans, and prescriptions written to treat your injuries.
  • >What parts of your body were injured and what injuries you were diagnosed as suffering from?
  • What your prognosis is and, if applicable, what your treatment plan is, and whether you are still in any pain. Were you referred to another provider for further treatment or follow-up?
  • Whether you are employed, and if so, whether you lost any wages due to missed time at work due to your injuries or treatment of your injuries.

After we have collected the necessary information, we will assess your case. You may expect some of the following from us:

  • We may need time to research and/or consider your case and will contact you promptly regarding whether we will represent you in your particular case. We may decline to take your case. We would do this for specific reasons, such as our current case load or whether pursuing your case would be economically reasonable. In this case, we may refer you to another lawyer.
  • If we will be representing you in your case, we will ask you to sign releases and medical authorizations so that we can obtain your medical records. We will also ask you to sign a fee agreement.
  • We will tell you what the next steps are. We will tell you not to talk about your case with others, including friends, relatives, and neighbors. Insurance company investigators or adjusters may try to contact you. If so, you should instruct them to speak only to us.
  • We will inform you on how we intend to keep you up-to-date on the progress of your case.
